This enactment implements certain sections of the agreement entitled “Nang K̲’uula • Nang K̲’úulaas Recognition Agreement”.
Bill S-16, now the Haida Nation Recognition Act, formally recognizes the Haida Nation and its governing body, the Council of the Haida Nation. It acknowledges the Haida Nation's inherent rights to self-governance and confirms the Council as the authorized representative body. This legislation implements key parts of the "Nang K̲’uula • Nang K̲’úulaas Recognition Agreement" between the Haida Nation, British Columbia, and Canada.
The Act grants the Council of the Haida Nation the legal status and powers of a natural person, allowing it to act on behalf of the Haida people. It also provides immunity for Haida Nation representatives and public officials from lawsuits for actions taken in good faith while performing their duties, while still holding the Council and Nation accountable for vicarious liability. This bill affects the Haida Nation by strengthening their governance structures and their relationship with the federal government.
