Bill Detail
An Act to amend the Canadian Security Intelligence Service Act (duty of candour)
This enactment amends the Canadian Security Intelligence Service Act to provide that the Canadian Security Intelligence Service shall report on breaches of its duty of candour to the courts. It also amends the oath of office taken by the Director and employees to include a solemn promise to fulfill that duty.
Bill C-331 aims to enhance transparency and accountability within Canada's security intelligence service (CSIS). It proposes that CSIS must report to the courts any instances where it may have breached its "duty of candour." This duty means being truthful and forthcoming with information when seeking warrants. The bill mandates that these reports detail the number of breaches, describe each one, and outline any actions CSIS took to fix the problem.
