Bill Detail
An Act to amend the Department of Canadian Heritage Act (Court Challenges Program)
This enactment amends the Department of Canadian Heritage Act to specify that, in exercising the powers and performing the duties and functions assigned to the Minister of Canadian Heritage under that Act, he or she shall maintain the Court Challenges Program.
Bill C-316 aims to legally protect the Court Challenges Program by amending the Department of Canadian Heritage Act. This bill ensures that the Minister of Canadian Heritage must maintain this program. The Court Challenges Program provides funding for legal cases of national significance that clarify or assert constitutional language rights and human rights, particularly those guaranteed by the Canadian Charter of Rights and Freedoms.
The program, originally created to help official language minority communities, has had a varied history of being cancelled and restored. This legislation seeks to provide stability and ensure an independently administered program that gives a voice to individuals and groups who may not otherwise be able to bring important cases before the courts. It aims to hold the government accountable and uphold fundamental rights.
